1. Agreement and eligibility

By creating an account or using Fair CarPool, you agree to these Terms and Conditions (“Terms”). Please do not use the service if you do not agree.

You must be at least 18 years old. Drivers must possess any driving licence, vehicle authorization, permits, and insurance required by the laws applicable to their journeys.

2. What Fair CarPool provides

Fair CarPool helps drivers publish available rides and lets passengers search for, request, or coordinate shared trips. It is a technology platform for matching and coordination. Unless expressly stated otherwise, Fair CarPool does not own or operate the vehicles used or itself provide transportation.

A listing, match, route suggestion, or estimated arrival time does not guarantee a ride, seat, fare, route, or arrival time.

3. Accounts and accurate information

Provide accurate, complete, and current account, profile, vehicle, and ride details. Keep your sign-in details secure and do not share access to your account. You are responsible for activity under your account, subject to applicable law.

Do not impersonate another person, provide forged documents, or publish misleading information. Inform us promptly if you suspect unauthorized account use.

4. Rides, bookings, and payments

Drivers are responsible for the safe and lawful operation of their vehicles, route and driving decisions, and their compliance with licence, insurance, and other applicable requirements. Passengers are responsible for evaluating their chosen ride, arriving at the agreed point on time, and following reasonable safety instructions.

Before confirming, review the route, pickup and drop-off locations, schedule, price, payment method, cancellation terms, and fees, if any, displayed for the specific transaction. Cancellations, refunds, and payment disputes will be handled under the terms displayed for that transaction and applicable law. Estimated prices and travel times are not necessarily guaranteed.

Where third-party payment providers are used, additional processor terms may apply to payment processing.

5. Location and safety

Use location sharing, ride tracking, chat, and other tools only for their intended trip-coordination purposes. Take appropriate personal safety precautions, meet in public places where practical, and verify the vehicle and participants before travelling.

SOS and emergency-contact tools are supportive app features, not replacements for police, ambulance, or other local emergency services. Fair CarPool cannot guarantee the identity, behaviour, legal compliance, driving ability, or safety of another user.

6. User content and conduct

You are responsible for the profile information, ride descriptions, messages, photos, reviews, complaints, and other content you submit. Do not post anything unlawful, threatening, harassing, discriminatory, sexually exploitative, deceptive, privacy-invasive, or otherwise infringing another person's rights.

Do not use Fair CarPool to spam, scam, intimidate, impersonate others, harvest information without authorization, or carry out unlawful activity. You may report content or behaviour using available app tools.

We may review reports and take appropriate action when necessary, including removal of content or limiting or suspending accounts. Such review does not mean all user content is automatically screened.

7. Privacy

How Fair CarPool handles personal information is explained in the Privacy Policy. Using location sharing, messaging, payments, and support features may involve processing or sharing relevant information as explained there.

8. Suspension and termination

We may restrict or suspend access when reasonably necessary to protect participants, investigate suspected misuse, comply with legal requirements, or enforce these Terms.

You may stop using Fair CarPool and request account deletion through the app or the methods described on our Account Deletion page. Some information may be retained where lawful and necessary, as explained in the Privacy Policy.

9. Disclaimers and liability

The app is provided subject to applicable law. To the extent permitted by law, we do not guarantee an uninterrupted or error-free service, successful ride matching, or the conduct or reliability of another participant.

Nothing in these Terms limits or excludes any consumer right, remedy, or legal liability that cannot lawfully be limited or excluded. Any liability arising from use of Fair CarPool is subject to the mandatory laws that apply to the relevant circumstances.

10. Changes, applicable law, and contact

These Terms may be updated from time to time. When we post a revision, the “Last updated” date will change. Continued use following updates constitutes acceptance to the extent permitted by applicable law.

These Terms are interpreted under applicable laws, subject to any mandatory consumer protection rights that cannot be waived.
